Notices and requests related to An Act respecting First Nations, Inuit and Métis children, youth and families

Section 25 of the Act respecting First Nations, Inuit and Métis children, youth and families (the Act) requires that certain information provided under section 20 be posted online or made accessible to the public. The tables below display the notices and requests received by Indigenous Services Canada (ISC) under section 20 of the Act as well as information provided to ISC concerning Indigenous child and family services laws developed under the framework made pursuant to the Act.

Publication of this information is not intended to confirm any rights recognized and affirmed by section 35 of the Constitution Act, 1982, the status of any notices or requests provided under section 20 of the Act, or the validity of the authorization of each Indigenous governing body.

Notices of intention to exercise legislative authority

Subsection 20(1) of the Act provides that an Indigenous governing body, acting on behalf of an Indigenous group, community or people, may give notice of their intention to exercise its legislative authority in relation to child and family services to the Minister of Indigenous Services and the government of each province and territory in which the group, community or people is located.

Requests to enter into a coordination agreement

Subsection 20(2) of the Act provides that an Indigenous governing body acting on behalf of an Indigenous group, community or people may request a coordination agreement with the Minister of Indigenous Services and the government of each province or territory in which the group, community or people is located in relation to the exercise of the group, community or people’s legislative authority. Note that requests provided under subsection 20(2) are implicitly considered notices of intent to exercise jurisdiction.

Within 12 months following the request, if a tripartite coordination agreement is reached, or no agreement is reached but reasonable efforts were made to reach an agreement, the laws of the Indigenous group and community would have force of law as federal law and would prevail over federal and provincial or territorial laws.

Such Indigenous laws must still respect sections 10 to 15 of the Act, the Canadian Human Rights Act and the Canadian Charter of Rights and Freedoms.

This table shows requests submitted to ISC, information on when coordination agreements were entered into with Indigenous governing bodies, and the date the Indigenous law comes into force. *Of note, under the Act, the date on which the request is made triggers a 12-month period after which an Indigenous governing body’s Indigenous law can come into force as federal law, as long as the Indigenous governing body made reasonable efforts to enter into a coordination agreement. If these conditions are met, subject to some exceptions, their Indigenous law will prevail over conflicting provincial, territorial and federal legislation. The date on which the request is received by Indigenous Services Canada is included in the chart below as it constitutes a mandatory obligation under subsection 25(a) of the Act.
